Resumen / Abstract: La historia de la cooperación monetaria y financiera internacional da cuenta de la forma en que el sistema monetario influyó en el mercado financiero internacional. En las páginas que siguen se podrá observar cómo los países intentaron su equilibrio interno y externo, a través de sus diversos mecanismos monetarios internacionales. El período patrón oro (1870-1914), merece atención, porque las tentativas subsiguientes de reformar el sistema monetario internacional, sobre la base de tipos de cambio fijos, se la construyó sobre la fortaleza del patrón oro. Los años de entreguerras (1918-1939) fueron marcados por la tendencia en la impresión desbocada de billetes, lo que trajo altos niveles de inflación. El Acuerdo Bretton Woods (1945-1973), que crea el Fondo Monetario Internacional, fue el resultado de la enorme preocupación de los gobiernos de cuarenta y cuatro países, por los acontecimientos económicos desastrosos en el período de entreguerras.; A history of international monetary and financial cooperation and its importance in the development of the international financial market relates the form in which the monetary system influenced the international financial markets. In the following pages we see how the countries tried to have internal and external balance through their diverse international monetary mechanisms. The gold standard period (1870-1914) deserves attention because the following attempts to reform the international monetary system based on the types of fixed exchange were built on the strength of the gold standard. The years between the two world wars (1918-1939) were marked by the trend towards runaway printing of money which brought high levels of inflation. The Bretton Woods Accord (1945-1973) that created the International Monetary Fund was the result of the enormous concern on the part of the governments from forty-five countries about the disastrous economic events during the period between the world wars.2008-01-01T00:00:00ZQuince minutos de fama financiera: la historia de Marc A. Resumen / Abstract: La problemática de la deuda externa ecuatoriana puede mirarse a través de varias formas y puntos de vista, notablemente, en virtud de técnicas jurídicas, financieras, sociales, etc. El problema con estos puntos de vista es que al ser orientados a grupos específicos, terminan siendo de difícil digestión para el común de las personas. Este artículo pretende revisar un importante episodio financiero desde una perspectiva histórica, más cálida y alejada de tecnicismos, es una historia de ambición que narra un pequeño capítulo en la vida de un hombre: Marc Hélie quien, a nombre de la transparencia e integridad de los mercados internacionales, por poco destruye a un país solo para terminar relegado de los mercados a los que decía defender.; The problem of Ecuadorian foreign debt may be studied through many different points of view, Le.: legally, financially, socially, etc. The main difficulty with al! this approximations is that, being directed to specific groups, it fails to reach the rest of people. Resumen / Abstract: A nivel internacional existe consenso respecto a la importancia que tiene el marco institucional para el funcionamiento eficiente del sistema financiero y para la generación de incentivos correctos para mantener la disciplina de mercado. Por eso mismo, durante los últimos diez años, se ha estado discutiendo, especialmente a nivel técnico, respecto de las condiciones de una nueva arquitectura financiera internacional que se ajuste a la realidad de un sistema financiero globalizado, y se han generado políticas, lineamientos y mínimos estándares para los sistemas financieros que han sido recogidos fundamentalmente por normas informales conocidas como softlaw y por órganos igualmente informales. La Declaración de la Cumbre del G20 en Washington de noviembre de 2008 estableció cinco principios comunes para reforma del sistema financiero que deben ser considerados en esta nueva arquitectura, a la que se puede definir como ""el establecimiento e implementación, a nivel nacional e internacional, de reglas, principios y arreglos institucionales que aseguren la estabilidad del sistema financiero internacional, previniendo las crisis y estableciendo los mecanismos institucionales para enfrentarlas o mitigarlas"". Sin embargo de esto, no existe una conciencia clara de que el problema de la nueva arquitectura financiera internacional es un problema ante todo jurídico: los órganos informales creados y el softlaw son insuficientes para crear las condiciones necesarias para asegurar el obligatorio cumplimiento y la aplicación general de este marco de regulación financiera global. Además, el principio de la soberanía de los Estados, base de los ordenamientos y sistemas jurídicos actuales, de naturaleza fundamentalmente nacional, y norma fundamental para las relaciones entre Estados, en el Derecho público internacional, vuelve complejay demorada la creación de un nuevo sistema de gobernanza global que viabilice esta nueva arquitectura financiera internacional y permita devolver rápidamente la confianza perdida y la estabilidad de este nuevo sistema financiero global.; There is an international consensus on the importance of an institutional framework for the efficient working of the financial system and the generation of the right incentives for maintaining market discipline. Therefore, during the last ten years there have been discussions, especially at the technical level, on the conditions for a new international financial architecture that adjusts to a global financial system. They have generated policies, guidelines and minimum standards for financial systems that are contained basically in informal standards known as ""soft law"" and by organizations that are also informal. The Declaration of the G20 Summit Meeting in Washington in November 2008, established five common principies for reforming the financial system that should be considered in this new architecture and which may be defined as, ""the establishment and implementation at the national and international level of rules, principies and institutional arrangements that ensure the stability of the international financial system, prevent crises and establish institutional mechanisms for confronting or mitigating them."" However, there is no clear awareness that the problem with the new international financial architecture is, above all, a legal problem. The informal organizations created and softlaw are insufficient to create the conditions necessary to ensure mandatory compliance and general application of this institutional arrangements framework and global financial regulation. Furthermore, the principe of the states sovereignty, the basis for current laws and legal systems which are fundamentally national and a fundamental standard for the relationships among states in international public law, becomes complex and delays the creation of a new global governing system that would make this new international financial architecture viable and allow a quick return to the trust lost and stability of this new global financial system.2008-01-01T00:00:00Z
