dc.description.abstractEl análisis de la prueba y de los medios probatorios en particular en materia penal, resulta de extrema necesidad para el profesional del derecho que desarrolla su actividad tanto en el libre ejercicio como dentro de la magistratura, pues en uno u otro ámbito se requiere que el Abogado profundice sus conocimientos en este tema, que le permita ejercer una eficaz defensa de su cliente ya sea en calidad de acusador particular o acusado, en el primer caso; y, una adecuada motivación de sus fallos en el segundo. El presente trabajo pretende aportar en la investigación de este ámbito jurídico, a través de la clarificación de conceptos respecto a la prueba penal, el análisis de los principios fundamentales que orientan la misma, los sistemas para su valoración y los medios probatorios admitidos por nuestra legislación. La tesis se desarrolla en cuatro capítulos el primero de los cuales se refiere a las nociones generales sobre la prueba y su valoración, analizando en el mismo, aspectos primordiales referentes a la actividad probatoria y orientando el enfoque al ámbito penal, resaltando el análisis de la eficacia probatoria de los modernos medios de prueba como los videos y medios magnetofónicos. A partir del capítulo II se analizan en concreto los medios probatorios en materia penal, empezando por la denominada prueba material y su trascendental importancia en figuras delictivas que impliquen la muerte de una persona, y en las de aborto, envenenamiento, lesiones y contra la propiedad, al igual que la actuación pericial. En el capítulo III se examina la prueba testimonial, orientando la investigación hacia los tipos de testimonios que contempla nuestra legislación, en base al análisis de normas legales vigentes. En el capítulo IV se examina la denominada prueba documental y las excepciones a garantías constitucionales básicas como la inviolabilidad de la correspondencia, en los casos expresamente señalados en la ley.es_ES
