Resumen / Abstract: Como en otros países de América Latina en el Perú el sistema de justicia padece diversos y complejos problemas estructurales que impiden el cumplimiento del rol central que la sociedad le da en el marco de un estado democrático. Algunos de estos problemas son: el sometimiento político a gobiernos y partidos políticos con el fin de mantener debilitado al sistema de justicia y poder controlar a jueces y fiscales; la anacrónica formación jurídica universitaria, apegada al estudio de códigos donde prima “la letra” de la ley en detrimento del “espíritu” de la misma. A esto hay que agregar un sistema diseñado sin tomar en cuenta el carácter multicultural de nuestro país, lo que lleva a que grandes sectores sociales, históricamente excluidos, sean discriminados por la justicia en razón de su idioma, raza, cultura; pero pocas veces se ha dicho que el sistema de justicia excluye también, en razón del sexo y el género, a las mujeres.

What are "Moral Rights"?

In addition to the right of licensors to request removal of their name from the work when used in a derivative or collective they don't like, copyright laws in most jurisdictions around the world (with the notable exception of the US except in very limited circumstances) grant creators "moral rights" which may provide some redress if a derivative work represents a "derogatory treatment" of the licensor's work.
