This study addresses the complex evolution of the multispecies family in Colombia, exploring the boundaries of legal recognition and the delicate balance of rights between humans and animals. Through a qualitative documentary analysis and a teleological legal hermeneutic approach, specialized doctrine, legislation, and recent jurisprudence are triangulated to fully understand this phenomenon. The findings reveal a marked judicial tension: while lower courts and dissenting opinions advocate direct recognition of the family category, the Constitutional Court maintains a prudent, anthropocentric stance. Its approach protects the affective bond indirectly, relying on the caregiver’s fundamental rights—such as the free development of personality and intimacy—while rejecting, for now, the constitutional redefinition of the family concept. Furthermore, a critical procedural void regarding custody disputes is identified. It is concluded that legal evolution will not lead to a new dogmatic family category, but rather toward a pragmatic protection of the bond (custody and maintenance) grounded in animal welfare. As an original contribution, we propose transitioning from rigid anthropocentrism to a ‘relational responsibility’ model, where animal sentience acts as an ethical and legal limit to property rights.
