Resumen / Abstract: La reforma a la Ley Reformatoria a la Ley Notarial, publicada en el Registro Oficial No 406 del 28 de noviembre del 2006, entrega a los notarios ecuatorianos nuevas atribuciones, en los actos de jurisdicción voluntaria. Un tema que surge a discusión es si los notarios ejercen jurisdicción voluntaria de forma plena, o está limitada a ciertos actos. Las variantes doctrinarias de si existe jurisdicción voluntaria son abordadas desde distintas ópticas sin que ninguna de las teorías de su naturaleza alcance unanimidad, por lo que al no estar justificada teóricamente, países vecinos no incorporan esta institución en sus legislaciones procesales. Al ser analizada a profundidad son evidentes sus inconsistencias que ha hecho que todo el talento humano designado para la resolución de conflictos de intereses deba ocupar su valioso tiempo para asuntos, en los que, existiendo un acuerdo previo, se lo tramite con un procedimiento muy similar a los asuntos contenciosos. Por ello propongo un análisis comparativo entre el procedimiento que realiza el juez como el notario identificando cada una de las fases que cumplen ambos funcionarios, haciéndose evidentes las ventajas de que todos los asuntos de jurisdicción voluntaria sean resueltos exclusivamente por el notario. La diferencia de procedimientos en el ejercicio de la jurisdicción voluntaria, respecto de lo que ejecuta el juez y notario, permite identificar las diferencias que básicamente son formales, desde la demanda respecto de la petición, del acta notarial en relación a la sentencia, ha hecho que la gran cantidad de actos de jurisdicción voluntaria retarden el despacho de las causas contenciosas. Por lo que proponer los fundamentos que hacen factible el ingreso en nuestra legislación procesal civil y notarial, de los actos no contenciosos, cuyo procedimiento y resolución de esos actos debería ser de conocimiento exclusivo de los notarios, implicaría una reforma sin precedentes en nuestro país que contribuiría a agilitar el acceso a la justicia de los ciudadanos ecuatorianos. Mi desempeño como notario público del cantón Quito, además siendo operador de la Función Judicial, me permiten reflexionar si verdaderamente existe la jurisdicción voluntaria y sobre todo si la misma está limitada a ciertos actos, para los notarios. Entonces la reforma debería emprenderse por la eliminación de la jurisdicción voluntaria y su reemplazo por los actos no contenciosos en el Código de Procedimiento Civil y la Ley Notarial. Por lo que la eventualidad de que un asunto no contencioso 5 se transforme en controvertido no constituye problema para emprender en la reforma que justificaré en el desarrollo del presente trabajo. Ya que de ocurrir se establece un procedimiento único para los casos en los que se produzca resolviendo de esta forma la eventualidad antes referida. En el evento de que no exista acuerdo para llevar a cabo un acto no contencioso ante el notario, en consecuencia ante un juez de lo civil, se debería seguir el mismo procedimiento para los asuntos no contenciosos que se convirtieron en controvertidos, más la obligación constitucional y procesal de realizar la citación al demandado.
