dc.description.abstractEl ejercicio de la administración de justicia de los pueblos indígenas es uno de los derechos colectivos más visibilizados en la sociedad ecuatoriana; sus prácticas, vistas desde una concepción occidental, han sido cuestionadas al argumentar que los usos y costumbres propios contravienen los principios de los derechos humanos. El presente estudio pretende aclarar el contexto y la definición de la justicia indígena como derecho propio, diferenciándola de otros hechos, tales como el linchamiento y ajusticiamiento. Reflexiona sobre cómo los derechos individuales (a la vida, la libertad, integridad, propiedad) están garantizados en la aplicación de la justicia indígena y analiza los mecanismos de conciliación que pueden interactuar y fortalecer los dos sistemas de justicia, a partir del reconocimiento y respeto del derecho propio, el diálogo intercultural, el desarrollo de las leyes y la constitución de un sistema jurídico de los pueblos indígenas. Para lograr el pleno ejercicio del derecho propio, el estudio analiza la Constitución del Ecuador, los instrumentos internacionales sobre pueblos indígenas, normas que de una u otra manera garantizan los principios, procedimientos y autonomía de la justicia indígena. Finalmente, a partir del análisis de expedientes, el trabajo reflexiona sobre las fiscalías indígenas, independientemente de cada uno de los actores: indígenas, instituciones, jueces, fiscales. En relación a la incidencia en la justicia indígena, se plantea la preocupación de si las fiscalías indígenas pueden llegar a constituirse en un espacio que atente contra la autonomía y la facultad jurisdiccional que tienen las autoridades indígenas, principio consagrado en el Art. 171 de la Constitución de la República del Ecuador.es_ES
