dc.description.abstractLa vigente Constitución Política de la República del Ecuador, en su artículo 35 numeral 9º, determina de manera expresa el régimen legal, al que deben estar sujetos los servidores, autoridades, empleados, trabajadores y obreros que prestan sus servicios en el sector público, determinando que en el caso de las personas jurídicas creadas por Ley para el ejercicio de la potestad estatal, y las Instituciones del Estado que ejerzan actividades que no puedan delegar sus actividades al sector privado, las relaciones con sus servidores se regularán por el Derecho Administrativo, con excepción de los obreros que se regirán por el derecho del Trabajo. Y en el caso de las Instituciones del Estado que si pueden delegar sus actividades al sector privado, las relaciones se regularán por el Derecho del Trabajo con excepción de las funciones de dirección, gerencia, representación, asesoría, jefatura departamental, las cuales se sujetarán al derecho administrativo. La expedición de la Ley Orgánica de Servicio Civil y Carrera Administrativa y de Unificación y Homologación de las Remuneraciones del Sector Público, LOSCCA, vulneró este mandato constitucional, sujetando a los trabajadores y obreros del sector público a esta Ley del Derecho Administrativo. Este quebrantamiento a la Ley Suprema fue demandado ante el Tribunal Constitucional, Órgano supremo de control constitucional que debe asegurar la eficacia de las normas supremas en especial las que consagran los derechos y garantías referentes al régimen jurídico al que pertenecen los trabajadores en el numeral 9º del artículo 35 de la Constitución. El Tribunal si bien reconoce la vigencia del régimen del Derecho del Trabajo, expide una Resolución ambigua, desautorizando a la Tercera Sala que en cumplimiento de su obligación, declaró en su informe que esta Ley no era orgánica, y que no debía regir una ley del derecho administrativo a los trabajadores sujetos al Derecho del Trabajo; sin embargo el pleno del Tribunal dejó vigentes normas de la Ley que contradicen su pronunciamiento creando una inseguridad jurídica que ha causado un daño irreparable al Estado Social de Derecho y ha destruido la paz laboral en el sector público. Bajo estos contenidos de la tesis nos hemos propuesto como objetivo fundamental el de ubicar a cada régimen su ámbito de regulación, el de las autoridades, funcionarios y empleados, la Ley del Derecho Administrativo, y para los trabajadores y obreros el Derecho del Trabajo, tal como lo prescribe la Constitución, para de esa manera hacer prevalecer la supremacía de la Carta Magna, frente a leyes de menor jerarquía que deben mantener concordancia y sujeción a sus enunciados.es_ES
